TVA's Secret Deal with TGP: What You Need to Know

Urgent Update for Cheatham County Residents & Landowners


It's come to our attention that the Tennessee Valley Authority (TVA) is planning to execute a precedent agreement with Tennessee Gas Pipeline (TGP)/Kinder Morgan for the Cheatham Gas pipeline within the next 24 hours. This development is deeply concerning for all of us who have been actively opposing this project.


We’ve also learned of a secret “reimbursement” agreement between TVA and TGP, signed in June 2023 before TVA held its first public open house in Ashland City to unveil the plans for the methane gas plant on Lockertsville Rd. Not only does this agreement reveal a troubling lack of transparency, it’s a deliberate effort to keep the public in the dark.


The scope of work detailed on page 1 of the reimbursement agreement is particularly alarming and in our opinion is a grotesque violation of privacy.

 

  • Due Diligence Activities: In the reimbursement agreement, TVA directs TGP to use both internal and external resources to conduct discreet due diligence, which includes Preliminary title and landowner research and Route reconnaissance.

 

  • Confidentiality Clause: In the reimbursement agreement, TVA explicitly instructs TGP not to discuss the project with public stakeholders. The “Agreement” states; “The Parties agree to (a) keep the Cheatham County Project, including the Work and the fact that TGP may be, or has been, participating in discussions with TVA regarding the Cheatham County Project confidential (collectively, “Confidential Information”) and ensure that it does not disclose or permit the disclosure of Confidential Information to any person or a public forum or website and (b) take steps that are reasonably necessary, prudent or desirable to safeguard the confidentiality of the Confidential Information.”


This level of deception and secrecy is unacceptable. TVA's attempt to keep the public and local stakeholders in the dark about a project that will irreversibly impact our community and environment is a direct violation of our right to be informed and involved in decisions that affect us. We’ve also obtained the contact information for the coordinator with Tennessee Gas Pipeline. Maybe we should introduce ourselves! Questions related to TGP activities should be directed to:

Our community deserves to know the full extent of the plans for the ENTIRE TVA plan including the Cheatham Gas pipeline and have a say in whether or not it goes forward.
